Terms of Service

Warmerly is operated by Kristiyan Tsvetanov, a UK-based sole trader trading as "Warmerly" ("we", "us", "our"). Warmerly is not a limited company. These Terms of Service ("Terms") govern your access to and use of Warmerly. By creating an account or using the service, you agree to these Terms.

1. The service

Warmerly is an email warmup service that connects to mailboxes you authorise and generates conversational mail with peer mailboxes in our network to build sender reputation. We do not run cold outreach campaigns on your behalf and we are not a sending platform for unsolicited bulk mail.

2. Your account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must be at least 18 years old and have legal authority to use the mailboxes you connect.

3. Acceptable use

See our Acceptable Use Policy. In summary: no spam, no phishing, no malware, no scraping, no harassment, no resale without permission.

4. Subscription, billing, and refunds

  • Plans renew monthly until cancelled.
  • Cancellation takes effect at the end of the current billing cycle.
  • We offer a 30-day refund window from your first paid invoice, no questions asked.
  • Pricing is shown in USD by default (GBP also available). VAT is added where applicable for GBP billing.
  • Failed payments may result in service suspension after 7 days.

5. Data ownership

You own your data. Warmerly holds it as a processor on your behalf. On account deletion, your data is removed within 90 days.

6. Service availability

We aim for 99.9% monthly uptime. Scheduled maintenance windows are announced in advance. We are not liable for downtime caused by force majeure, third-party providers (Google, Microsoft, etc.), or your own configuration.

7. Warranty disclaimer

Warmerly is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee any specific deliverability outcome. Email reputation depends on factors outside our control, including your content, list quality, sending volume, and DNS configuration.

8. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data.

9. Indemnity

You agree to indemnify and hold Warmerly harmless from any claims arising from your use of the service, your content, your mailing lists, or your violation of these Terms or applicable law.

10. Termination

We may suspend or terminate your account for breach of these Terms or our Acceptable Use Policy, with or without notice depending on severity. You may terminate at any time from your account settings.

11. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes

We may update these Terms. Material changes are notified by email at least 30 days before they take effect.
