Lead Database Use Terms
These terms govern your use of the business-contact database behind Warmerly's lead finder and email finder, and the records you search, select, or export from it. They form part of our Terms of Service and apply whenever your account touches that database, whether through the app or the API.
1. Exporting a record makes you the controller of that copy
The database itself is compiled and controlled by Warmerly, as described in our Prospect Privacy Notice. The moment you export, select-to-campaign, or otherwise take a record out of the database into your own workspace, campaign, or CRM, you become the data controller of that copy. This is a binding obligation, not a formality: from that point on, you — not Warmerly — are legally responsible for how that record is used, stored, and disposed of, and for having a lawful basis to contact the person or business it identifies. Our DPA and Warmerly's processor role do not extend to what you do with an exported record after export.
2. Permitted use
You may use exported records for your own outreach — email or LinkedIn campaigns you run through Warmerly or elsewhere, on your own behalf or your client's, subject to the outreach obligations in Terms §4 (lawful basis, accurate sender identification, honouring opt-outs).
3. Prohibited use
Exported records may not be:
- Resold or re-listed — as a standalone dataset, bundled with other data, or repackaged as a lead list or database product for anyone else.
- Used for enrichment-for-hire — appending, matching, or enriching a third party's records as a service, whether paid or not.
- Appended to a third-party database — merged into someone else's contact database, CRM instance, or dataset that you don't control, or handed off to a data broker.
In short: the export is for you to contact those businesses yourself, not to become a source of supply for anyone else's database or outreach.
4. Suppression
Warmerly maintains a suppression list of people and domains who have asked not to be contacted. If a record you exported is later added to that list — because the person unsubscribed, objected under our Prospect Privacy Notice, or asked us directly — you must stop contacting them with that record and honour the suppression yourself, including in any copy you hold outside Warmerly. If we forward you a suppression or objection request that names a record you exported, you must action it without undue delay.
5. Accuracy
As set out in our Terms, data in the business-contact database is compiled from public sources and inference, and is not guaranteed to be accurate or current. You are responsible for reviewing what you send, and for correcting or removing your own copy of a record you know to be wrong.
6. Breach of these terms
Using exported records for a prohibited purpose is a breach of our Terms of Service and may result in suspension of your database access, your account, or both, in addition to any other remedy available to us.
